Contractual Presentation
 
Completion of the contract between Eco Expedition Electric Bikes (the supplier) and you (the customer) will only be deemed to be completed when the goods are fully paid for and have been despatched from our warehouse, until fully paid for the cycle remains the property of Eco Expedition Electric Bikes. Purchasers understand and agree that no officer, director, employee or salesman of Eco Expedition Electric Bikes has any authority to make any statement contrary to the terms of this contract. On the contrary, Expedition Electric Bikes disavows any statement contrary to these terms and conditions. 
 
You will remember to continually check the terms and conditions and will be bound by the terms and conditions in force at any time that you use the website. Items, prices, availability and descriptions may be changed at any time and without notice to ensure information is as accurate and as up to date as possible. While we endeavour to ensure all information is accurate and all pictures are an accurate representation of our actual products, minor variations in size, design, features or colour may occur.
 
You will ensure that all information you provide to us is accurate and complete in all respects, and accept responsibility for any costs that may occur as a result of inaccurate or incomplete information being provided.
 
We recommend you use up to date antivirus, firewall and security software as although we take great care to ensure our website is safe, we cannot guarantee our website will be free of viruses or malicious software. We take no responsibility for loss or damage to files or computer equipment as a result of visiting our website.
 
We will not be liable if a third party is able access the data you provide when assessing or ordering from the site. By assessing and/or ordering from our site you agree to take full responsibility for protecting your data from unauthorised use by a third party, including responsibility for any damage or losses incurred as a result of visiting our site.
 
Any advice given by agents or servants of Eco Expedition Electric Bikes during telephone/email/internet conversations is based entirely upon information given by you the customer. Where advice is given after visual inspection by agents or servants of Eco Expedition Electric Bikes, such advice shall amount to an opinion only and Eco Expedition Electric Bikes shall not accept liability for any inaccuracies. Additionally, goods are supplied only to correspond to the purpose for which goods of that kind are commonly supplied and not alternative uses to which they may be put. No liability for failure can be accepted by Eco Expedition Electric Bikes for such alternative use, amendment or modification.
 
Eco Expedition Electric Bikes is constantly seeking ways to improve the specification, design and production of its parts and from time to time alterations to the specification and design may occur. Whilst every care is made to present the cycles with up to date description and photographs, the description and photographs contained within this website and any supporting brochure should be considered for guidance purposes only. Content within the brochure, website and photos may be subject to change without prior notice.
 
Prices
 
The prices stated within this website are applicable only to online purchases through this website. Eco Expedition Electric Bikes is under no obligation to uphold any price or promotion that varies from the website prices.
 
VAT
 
Goods sold to consumers in the UK will be subject to VAT surcharge of 20%, this VAT rate is already included within the stated prices of the website.
 
Ordering/Carriage Costs
 
Follow the normal and logical route through the online shop and checkout.
 
For the benefit and security of our customers, our online card payments are handled securely by PayPal. For orders paid for using this method, we can only ship goods to the delivery address that has been provided to PayPal at the time of ordering, unless agreed otherwise. Please be sure to review and check that the correct address has been entered at the point of payment.
 
Eco Expedition Electric Bikes hold good stocks of all items, but in the rare event of an item being out of stock we will notify an estimated delivery time, your order will remain 'live' unless you telephone or email a cancellation, in the latter event we will reply to your cancellation.
 
It is important you check your order carefully, whilst we are happy to credit a bicycle wrongly ordered or not required, you will be expected to pay the outbound and return carriage costs and further carriage costs for any replacement subsequently despatched, the return carriage costs can be particularly expensive.
 
Payment
 
Eco Expedition Electric Bikes will accept payment for online orders using most credit or debit cards or by bank transfer. 
 
Card payment may be taken over the phone. 
 
If you wish to collect any items in person, we can only accept cash on collection or bank transfer payment, we do not have the means to accept a card payment for orders collected in person.
 
Delivery
 
Delivery charges vary according to your location. Most UK addresses can be delivered to free of charge, however other addresses deemed as outside the scope of mainland UK (as defined by our chosen couriers) will incur a surcharge.
 
The courier is TNT who will deliver Mon-Fri between 8:00am-6pm. If you are out at the time of delivery you will be left a card with instructions to follow to arrange a second delivery, and if they are not contacted, they will try delivery on the following working day. TNT can be contacted on 0800 100 600.
 
You will be required to leave a signature when the driver makes the delivery.
 
It is essential that you sign for your order as “un-checked” on arrival and make us aware of any damage within 48 hours of the order arriving. Please send us a photo of the damage to the box and/or the cycle and contact us immediately, some couriers have a restricted time in which we can make a claim for damage. Any claim made in excess of 48 hours after the delivery date will be rejected by the couriers and therefore cannot be resolved.
 
If your goods are faulty on arrival, you have 14 calendar days from receipt, in which to inform us of the fault.
 
If delivery is attempted on several occasions and nobody is at home to sign for the item, then the buyer will be responsible for any costs incurred with the return and re-dispatch.
 
Whilst we try to despatch your cycle as quickly as possible, it is not possible to specify a time for delivery, we can however offer an estimated day of arrival. However, we will keep you informed on any unexpected delays.
 
For export deliveries, please contact us directly.
 
All bikes are despatched in boxes, but please realise that boxed cycles are large bulky items to transport and as such may get the odd mark or scratch in transit. Collection is available at no extra cost and will certainly reduce the risk for damage caused by the couriers. The odd few minor marks are to be expected with any mail order bike, however the majority should arrive pristine. No compensation or replacement that can be offered for minor blemishes caused during delivery.
 
Cancellations
 
You may cancel your order PRIOR to despatch. Orders cancelled after despatch, even if not yet delivered will be treated as returns, and charges may apply. Any charges will be passed onto the buyer.
 
Suitability
 
Please be certain that the sizing of the bike is suitable before ordering. We have found that the size of this bike is a comfortable ride for people who are between 5ft 5 and 6ft 2 tall, this information is offered as a suggestion only and its recommended that you make sure the size of this bike will be suitable before ordering. This bike has 26" tyres and an 18" frame. If you are unsure if the size will be suitable, we recommend you come and take a test ride in person either at our office in Kent or one of our retailers. If this is not possible, most regular bike shops that stock mountain bikes will be able to let you try a bike of the same size out so you can gauge if the size will be suitable. We also recommend a maximum riders weight of around 110kg to prevent overload of the motor
 
Assembly
 
Our bike comes mostly assembled but will require some final assembly. Assembly instructions are provided but we strongly recommend that you take the bike to a professional bike mechanic or bike shop for assembly to prevent your bike from being damaged during assembly.
 
Once assembled the bike will also need a full inspection / check over and for necessary adjustments to be made before it can be ridden. Your chosen local bike shop/mechanic will be able to do this with ease (at your own cost).
 
All electronic components, circuitry etc are already pre-installed. The parts that will need assembly and adjustment are all standard bike components and would need to be checked and set up correctly whether you are purchasing an electric bike or a regular pedal bike.
 
In rare cases, the electronic brake sensors may need a minor adjustment before the motor will operate. Adjustment is very simple and full instructions are provided should you need to make the adjustment before use. The adjustment of the brake sensors usually takes 5 – 10 minutes.
 
Eco Expedition Electric Bikes will not be held liable for any injuries or damage caused by imporper assembly / adjustment / inspection prior to riding the bike.
 
Maintenance
 
As with all bikes (regular or electric), your bike must be carefully maintained and regularly serviced to maintain normal and proper function. Failure to do so will result in permanent damage. All the necessary and required maintenance instructions are included in the instruction manual.
 
It is also essential (as with any electric bike) that you have the spokes re-adjusted after around 100 miles of use to ensure that they bed into place correctly. This is an important step as any bike with an electric hub motor will put stress on the spokes and will take some time for the spokes to find their proper place. Your local bike shop will be able to make spoke adjustments and ensure the wheel is still in alignment for you
 
Returns
 
Returns are possible should you not be happy with your order but must be made within 14 days of arrival. All returns MUST be in unused and original condition suitable for re-sale. Return costs will be paid by the customer. We cannot accept returns on items which show signs of use or have been damaged or mis-treated.
 
Where goods purchased by you are alleged to be defective, you agree to advise us of such defects within 14 days of the goods being delivered to you or the defect becoming apparent and you agree within 14 days thereafter (and in accordance with our Returns Policy) to arrange for the return of such goods to us for inspection and report (without us replacing the said goods prior to such inspection). We will only collect from the original delivery address covering only the reasonable costs of collection where necessary. 
 
There must be no signs of wear and tear, marks, damage etc, and all original packaging must be put back into the box as it came out. All accessories / parts / tools included must also be returned with the item.
 
Please take extreme care when opening your order to prevent any damage to the original packaging should you need to send your order back to us. Please also take note on how the order arrived packed in the box should you need to put it back in.
 
The buyer has a legal obligation to treat goods with the absolute maximum level of care, and it's the buyers responsibility to ensure that goods arrive back in original excellent condition. Any damages that were caused whilst the bike was in your care will result in repair and refurbishment costs being passed onto you, the buyer. Bikes or components which have been sold as clearance items, such as reconditioned or ex-demonstrator models will be considered clearance stock and are sold on a sold as seen basis – returns are not possible on these purchases.
 
The buyer is liable for any collection costs incurred, and also a £45 inspection, re-packing and handling fee.
 
You further confirm that it shall be reasonable for us to inspect, repair or replace (at our option) such defective goods and allow our manufacturers or suppliers to undertake inspections so as to allow product methods to be modified. You also accept that it is reasonable to inform us of any interruption, defect or other failure prior to contacting independent third parties or incurring expenses and, in addition, to allow us to remedy the defect. Parts improperly fitted, assembled, modified or adapted by you shall no longer be warranted by us or any manufacturer or supplier to us, nor shall they or we be liable for any failures resulting subsequent to modification.
 
Warranties
 
All products are subject to the terms of the warranties issued with them.
 
From the date of purchase your new bike has a 12 month return to base warranty on the electronics only. Similarly, ex-demo or reconditioned bikes will be issued with a 6 month return to base warranty. Normal wear and tear, accident, abuse, misuse, neglect, poor maintenance, improper assembly and fitment of parts not consistent with the standard specification or use originally intended for the bicycle as sold, are not covered by this warranty.
 
Should there be a problem that is covered by the terms of the warranty during the period of warranty cover offered, you (the customer) can have the bike or faulty component sent back to us (at your own cost) and we will attempt to repair or replace the faulty component. Should the issue be covered by the terms of the warranty, we will cover reasonable costs of returning the item back to you. This will only apply to Mainland UK addresses (as defined by our chosen courier). Items that are to be returned to addresses outside of this Mainland UK area will result in any additional surcharges being passed onto you (the customer) and must be paid prior to dispatch of any items. Where an item is being returned or collected from you at our expense, we reserve the right to refuse delivery to such an address that differs from the original delivery address should it be an area our couriers charge a premium for e.g a remote or non Mainland UK area. Where a replacement bike or components are issued, the remaining warranty period that was applied from the original purchase date will be applied to the replacement / repaired item only. No extension to the warranty will be offered or is implied.
 
It is up to the sender to ensure that the bicycle or component is sent properly packed and fully bubble wrapped/protected.  It is the responsibility of the sender to avoid any damage in transit. Eco Expedition Electric Bikes will not be held responsible or accountable for any damage caused to items during transit. We also recommend that you ensure the consignment has adequate insurance to cover potential damage in transit.
 
Upon its return, we will test the bike or component in order to confirm the fault. Upon successful confirmation or replication of the fault we will provide a remedy or replacement part at our discretion. If the returned item is found to be without fault or found as faulty as a result of wear-and-tear, inappropriate use, collision, modification or as a result of the item being taken apart or not cared for correctly then the cost of return postage will be charged to the customer and no remedy will have to be offered at the discretion of Eco Expedition Electric Bikes. We reserve the right to refuse to repair items that are not covered by the warranty. We will not accept the return of any products or provide credits for products which are over 12 months old under any circumstances. The warranty is offered only to the original purchaser.
 
Whilst we endeavour to process warranty claims as quickly as possible, please allow up to 2 weeks in extreme cases for testing and remedy to take place.

No liability for failure can be accepted by Eco Expedition Electric Bikes for such alternative use, amendment or modification. 
 
Compatibility of goods is not guaranteed where modifications or alterations have been made and, in such circumstances, any remedy offered to you the customer shall be at Eco Expedition Electric Bikes sole discretion. 
 
Use of bike supplied by Eco Expedition Electric Bikes for hire or reward purposes invalidates any warranty.
 
E-bikes are generally heavier than normal cycles and thus are subject to greater stress.  The e-bike is not intended for stunt riding, ramp jumping, bunny hops, acrobatics or extreme rough surface off-road riding, it is up to the rider to determine whether such activity exceeds the capacity of the bicycle. The amount of load being put through the motor and the steepness of the hills being climbed should also be taken into consideration. Based on the size of the motor fitted to our bikes, any hill over 12% can subject the motor under excessive load and potentially cause it to fail – It is the rider responsibility to select an appropriate level of assistance (if any) for the terrain being ridden. For steeper hills, a bike with a larger motor would be recommended. Damaged cables, electronic components, the bending of frames, forks, stays, handlebars, seat posts, seat stems, mudguards, rims, is a sign of misuse of the bicycle inconsistent with the bike's intended use and therefore is not covered by this warranty. Damage caused by an accident or deliberate malicious act is not covered by this warranty.
 
The motors fitted to e-bikes intended to be used for pedal assistance purposes, are restricted to 250 watts power, so some pedal assistance is required to avoid over stressing the motor. In particular, allowing the motor to 'labour' at slow speeds on steep hills is not good practice and can cause the motor to overheat. Excessively steep hills can also cause the bike and operation to fail. Excessive use of the throttle without pedal assist is specifically to be avoided. A motor which has failed due to excessive heat will not be covered by warranty and is considered misuse of the product.
 
Battery warranty is subject to appropriate battery care – batteries should ideally be stored at room temperature.  Extended storage in high/low temperatures and/or fully discharged for more than (1) week can considerably reduce the life of the battery. We reserve the right to reject batteries without a valid serial number attached.
 
Advertised Statistics
 
Whilst the data and statistics indicated are reasonable and fair figures, all stated ranges / speeds / capacities / distances are offered as approximate figures only and can vary / fluctuate due to a variety of factors. Actual range / speed / performance may exceed / may be inferior to that indicated. All figures offered are as a guide only. 
 
Consumables
 
Bicycle parts normally subject to wear, such as tyres, chain and chainrings, brake pads, gear cassette, cables, pedals and handle grips are not covered by the warranty. 
 
Trademarks & Copyright
 
Our website is only available for personal or non-commercial use. Unless otherwise stated you must assume the contents of this website are protected by international copyright law.
 
Liability
 
We will not be held responsible for any indirect or consequential loss of any kind whatsoever that may occur as a result of using our website, or buying or using any of our products. This includes but is not limited to any costs, wages, inconvenience or goodwill.
 
We do not in anyway limit our liability for any matter it would be illegal or illegal to attempt to exclude our liability for.
 
We reserve the right to hold buyers responsible for any loss or costs we suffer or incur as a result of you not complying with these terms and conditions.
We shall accept no liability for death or personal injury unless caused directly by Eco Expedition Electric Bikes negligence in circumstances where assembly has been effected otherwise than in strictly in accordance with the instructions set out in the manual and/or attached to the product or where modifications or alterations and/or poor or irregular servicing or maintenance to goods have been made. No liability is accepted by us where you attempt to modify or install components supplied where it is known or ought reasonably to be known that the part supplied is incorrectly supplied, defective or otherwise not in accordance with the order.
 
We accept no liability for accidental or consequential damage or loss of any other matters beyond our reasonable control or in respect of failure to supply or other interruptions caused by strikes, lockouts, civil disputes, acts of God, war or actions by third parties.
 
Overseas & Non-Mainland UK Customers
 
Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of our website or the placing of any order through our website from outside the UK complies with any applicable non-UK laws or regulations. Any customs or import duties levied once the package reaches your destination country will be your responsibility as we have no control over these charges and cannot predict them. In addition, in the event that the bike needs to be returned to ourselves for warranty work, we are only able to arrange delivery to and from the original mainland UK delivery address or an alternative mainland UK delivery address at our discretion. We will be unable to arrange collections or deliveries to overseas or non-mainland UK addresses.
